The following is an example of a letter to be filled out on acceptance of a commission.
 
Such letters can be used when accepting a commission from a newspaper, magazine or other editor. Or when commissioned to do editorial work by agencies.
 
When possible, the below should be designed on your letterhead and saved and shared as a PDF file.

Copyright: Copyright rests with the freelancer as per South African copyright law 1978, Section 21 (1) (1) (c), unless otherwise negotiated.
 
Usage: Once-off publication, one-language first South African Rights only. Any other use such as international, internet or inter-stable usage, must be negotiated separately.  
 
Kill fees: If the commissioning editor decides to kill the work after the brief has been met and work has been delivered by the deadline date, full payment will be made.
 
Rejection/dispute: If the commissioning editor considers that the brief has not been accurately followed, or the work is sub-standard, an opportunity must be given for the problem to be corrected. If the work is still not accepted and the freelancer feels this is unfair, the commissioning editor will allow an independent moderator to decide if any, and what payment should be made to the freelancer, and how to apportion the costs of mediation.
 
This agreement is subject to the attached SAFREA Recommended Terms & Conditions. 
 
Your acceptance of the above is taken upon your use of the material to which this agreement refers.
